Guest Waiver

BRADLEY FARM HOMEOWNERS ASSOCIATION, INC. POOL GUEST ACKNOWLEDGEMENT This Acknowledgement and Agreement ("Agreement") is required for guest use of the Bradley Farm swimming pool facilities ("Pool Area"). By signing (or electronically accepting) this Agreement, I acknowledge and agree as follows: 1. Inherent Risks of Pool Use I understand that swimming and use of the Pool Area involve inherent risks, including but not limited to drowning, near-drowning, slips and falls, collisions, injuries caused by others, and exposure to sun, heat, and other hazards. I understand these risks may result in serious injury or death. 2. Voluntary Participation & Assumption of Inherent Risks I voluntarily choose to use the Pool Area and assume responsibility for taking appropriate precautions for my own safety. I acknowledge that I am solely responsible for the security of my personal property and that the Association is not liable for loss, theft, or damage to personal belongings while using the pool facilities. 3. Agreement to Follow Pool Rules & Pool Staff Direction I agree to comply with all Pool Rules & Regulations, including any posted notices and all directions from Pool Staff. I understand that Pool Staff may enforce Pool Rules, including issuing warnings, requiring corrective action, and directing individuals to leave the Pool Area for safety or rule violations. 4. Swim Tests (If Applicable) I understand Pool Staff may require a swim test for safety reasons before allowing access to certain areas or activities. 5. Medical & Emergency Response Authorization I understand Pool Staff may render first aid and may contact emergency medical services as they deem appropriate. I authorize such emergency response if needed. 6. Video Surveillance Video surveillance is in use in the pool and surrounding common areas for safety, security, and rule enforcement purposes. Cameras are not placed in restrooms, changing areas, or other areas where a reasonable expectation of privacy exists. 7. No Waiver of Legal Rights / No Release of Negligence I understand this Agreement is an acknowledgement of risks and a commitment to follow Pool Rules. It is not a waiver or release of liability for the Association's or Pool Operator's negligence, to the extent such releases are restricted or unenforceable under Virginia law. 8. Severability If any portion of this Agreement is held invalid or unenforceable, the remainder shall continue in full force and effect.
